1. Acceptance of Terms
These Terms and Conditions (“Terms”) govern your use of the website ontimehvac.ca and all HVAC, cooling, heating, plumbing, and refrigeration services provided by ON TIME Heating, Cooling & Refrigeration (“ON TIME”, “we”, “us”, or “our”).
By scheduling an appointment, approving an estimate, signing a work order, or using our website, you agree to be legally bound by these Terms.
2. Services, Quotations & Free Estimates
ON TIME provides professional HVAC installations, furnace and air conditioning repairs, heat pump setups, geothermal services, indoor air quality tune-ups, and residential/commercial plumbing.
- Written Quotes: All formal quotes and estimates provided in writing remain valid for thirty (30) days from issuance unless explicitly stated otherwise.
- Scope of Work: Estimates cover only the specific materials, equipment, and labor detailed in the quote. Any unforeseen repairs, code compliance requirements, or hidden site conditions discovered during work will be quoted and approved prior to commencement.
- No Obligation: Initial consultation estimates for new system replacements are offered with zero obligation.
3. Appointments & Cancellations
We strive for 100% on-time arrivals. Arrival windows are provided to give homeowners flexibility.
Cancellation Policy: If you need to reschedule or cancel a non-emergency appointment, please provide at least 24 hours’ advance notice by calling +1 (226) 505-8904.
For 24/7 emergency dispatch requests, dispatch fees and expedited response protocols are communicated and agreed upon before a technician is dispatched to your property.
4. Pricing & Payment Terms
- Payment Due: Payment is due immediately upon completion of service, diagnostic inspection, or installation, unless prior commercial credit terms or financing arrangements have been approved.
- Accepted Methods: We accept major credit cards (Visa, MasterCard, Amex), debit, e-Transfer, and verified financing options.
- Taxes: Applicable Ontario taxes (HST) are added to all labor and material charges in accordance with provincial regulations.
- Late Payments: Overdue invoices may incur a monthly administrative finance charge of 2% (24% per annum) until settled in full.
5. Warranties & Workmanship Guarantees
We stand behind our craftsmanship and partner with top-rated HVAC manufacturers.
- Workmanship Warranty: All installation and repair labor is covered by our standard workmanship warranty against defects for a specified term documented on your invoice.
- Manufacturer Warranties: Equipment (e.g. furnaces, heat pumps, AC units, compressors) is covered under the respective manufacturer’s warranty. ON TIME will assist with warranty registration, but warranty terms are set by the manufacturer.
- Exclusions: Warranties do not cover damage caused by homeowner negligence, unauthorized third-party tampering, dirty filters, power surges, floods, or acts of God.
6. Customer Responsibilities & Site Access
To ensure safe and efficient execution of service, customers agree to:
- Provide safe, clear, and unobstructed access to the equipment (furnaces, utility closets, electrical panels, attics, crawlspaces, outdoor condenser units, and shutoff valves).
- Ensure a responsible adult (18 years or older) is present on the premises during the service visit.
- Secure pets and ensure the work area is safe and free of hazardous materials.
7. Limitation of Liability
To the maximum extent permitted by applicable law, ON TIME and its employees or contractors shall not be liable for indirect, incidental, punitive, or consequential damages resulting from pre-existing structural defects, electrical anomalies, unpermitted prior work, or water damage stemming from pre-existing plumbing deterioration.
Our maximum aggregate liability for any claim arising out of our services shall not exceed the total amount paid by the customer for the specific service call or installation giving rise to the claim.
8. Governing Law & Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any legal disputes arising hereunder shall be subject to the exclusive jurisdiction of the courts located in Waterloo Region, Ontario.
